Sen. John Cornyn, R-Texas, said Wednesday that he is \u201cnot prepared to vote yes\u201d on acting Attorney General\u00a0Todd Blanche\u2019s nomination to permanently head the Department of Justice.<\/p>\n

The Texas Republican \u2014 who lost his primary race in May to Texas Attorney General Ken Paxton, President Donald Trump\u2019s chosen candidate \u2014 was set to meet with Blanche on Wednesday morning ahead of Thursday\u2019s scheduled confirmation vote by the Senate Judiciary Committee. <\/p>\n

Cornyn, a member of the committee, is a key GOP holdout. One Republican no vote could sink Blanche\u2019s nomination.<\/p>\n

Cornyn has demanded that Blanche reopen and modify the controversial settlement agreement he brokered between Trump and the IRS. The senator has asked for proof that the proposed $1.8 billion \u201canti-weaponization\u201d fund established as part of that deal is formally dead, and he has also demanded Blanche narrow the tax audit immunity provisions the settlement afforded to Trump and his family.<\/p>\n

Cornyn called the meeting off after Blanche failed to provide \u201cwritten proposals to modify the release that was signed in the tax dispute with President Trump,\u201d as he had asked. He added that changes from Blanche \u201cin a modified release form\u201d would be \u201cwould be responsive\u201d to his request, but that \u201cfor some reason\u2026they simply refuse to do it.\u201d<\/p>\n

Shortly after the meeting was called off, a Justice Department official told MS NOW that the department \u201cprovided a written proposal to Senator Cornyn\u2019s staff yesterday following ongoing discussion with both the Committee and the Senator\u2019s office.\u201d Cornyn\u2019s office did not immediately return MS NOW\u2019s request for comment on the DOJ statement.<\/p>\n

Speaking to reporters after announcing the meeting would not take place, Cornyn said that there would be no need to have any such meeting \u201cif they will just produce the documentation that we\u2019ve requested,\u201d adding that Blanche testified under oath that he could meet the request during his confirmation hearing. <\/p>\n

Sen. Chuck Grassley, R-Iowa, asked Cornyn to decide on his position by 4 p.m. ET on Wednesday, Cornyn said.<\/p>\n

\u201cI\u2019m not prepared to vote yes,\u201d he added. \u201cLet me let me put it that way.\u201d<\/p>\n

Sen. Thom Tillis, R-N.C., has suggested that he, too, could oppose Blanche\u2019s confirmation in committee. Due to the narrow Republican majority on the panel, one no vote is enough to prevent Blanche\u2019s nomination from getting a Senate floor vote.<\/p>\n

\u201cMaybe they think I\u2019m just going to give up or you know go along, but they\u2019re mistaken,\u201d Cornyn said when asked why he thinks the DOJ could be slow-walking his request. <\/p>\n
