The Justice Department on Thursday withdrew the\u00a0subpoenas it issued\u00a0to\u00a0three reporters for the New York Times who reported on security concerns about the\u00a0new Air Force One\u00a0gifted to President Donald Trump by the Qatari royal family. The department also withdrew subpoenas to phone service providers for call records.<\/p>\n

The withdrawal comes after the Times moved to quash the subpoenas last week, arguing that they \u201crepresent a brazen effort to intimidate the press\u201d and \u201cviolate the most basic First Amendment protections for newsgathering activity.\u201d <\/p>\n

Press freedom groups, including the White House Correspondents\u2019 Association, also condemned the issuing of the subpoenas, alleging that the government issued them due to officials\u2019 embarrassment over the negative press rather than on any legitimate legal basis.The DOJ argued the journalists were not the targets of the subpoenas, and that they were instead seeking to identify who the government says leaked what it describes as national defense or classified information.<\/p>\n

In court on Thursday, Judge Arun Subramanian started by asking the government if it would withdraw the subpoenas and, when the DOJ declined, invited their lawyer to argue otherwise. In response,\u00a0Sean Buckley, the former deputy U.S. Attorney and current chief counsel to U.S. Attorney Jay Clayton, argued for the better part of an hour that the subpoenas were lawfully issued and said they were authorized by Acting Attorney General Todd Blanche. However, Buckley also admitted that the subpoenas erroneously sought information from a parent and spouses of the reporters as \u201ca consequence of trying to move quickly.\u201d<\/p>\n

The DOJ issued the subpoenas, which sought the Times\u2019 reporters phone records and grand jury testimonies, following the paper\u2019s coverage\u00a0earlier this month that stated the new plane lacks the critical defensive countermeasures the previous plane had. Following the Times\u2019 reporting, Trump swapped out the new plane for the original Air Force One for his flight from the\u00a0NATO summit\u00a0to the United Kingdom, as\u00a0MS NOW reported. He also dispatched FBI Director Kash Patel to\u00a0oversee a leak investigation\u00a0into the source of the Times\u2019 reporting. <\/p>\n

Thursday\u2019s news comes as a win for the newspaper \u2014 and for the First Amendment more broadly \u2014 at a time when the government has\u00a0sought to curtail press freedoms\u00a0through various legal actions\u00a0and leak investigations.<\/p>\n

In a statement provided to MS NOW, David McCraw, senior vice president and deputy general counsel for the Times, called the proceeding \u201can important affirmation of our country\u2019s commitment to a free press.\u201d<\/p>\n

\u201cWe are pleased that the government finally conceded that the subpoenas violated the law, but they should never have been issued in the first place,\u201d McGraw added. \u201cThe Times and our journalists will continue to report and seek the truth without fear or favor. We will not be deterred in the face of tactics like these.\u201d<\/p>\n

In a statement provided to CNBC, a spokesperson for the DOJ blasted Judge\u00a0Subramanian, arguing his conduct \u201coverrides clear longstanding principles and common sense \u2014 blocking the grand jury from receiving core evidence in a national security investigation.\u201d\u00a0<\/p>\n

\u201cMake no mistake, this investigation remains ongoing, and we will pursue justice against those threatening national security by leaking classified information, a serious federal crime,\u201d the spokesperson added.\u00a0<\/p>\n

After the hearing\u2019s conclusion, Subramanian issued an order cementing the withdrawal of the subpoenas and obligating the Justice Department to notify him, per its own offer at the hearing, before issuing new subpoenas to or about the reporters who brought Thursday\u2019s challenge.<\/p>\n

He also demanded the U.S. Attorney\u2019s Office provide the court with internal communications relating to their effort to keep the phone service provider subpoenas secret. Subramanian maintained that the Justice Department\u2019s application for a nondisclosure order was not warranted under the circumstances and reflected such a deviation from court rulings and regulations as to potentially warrant sanctions.<\/p>\n

After the government withdrew the subpoenas, David O\u2019Neill, the lead lawyer for the Times, told Subramanian that the DOJ\u2019s conduct in the case has been \u201creplete with bad faith and that\u2019s even clearer now.\u201d<\/p>\n

Subramanian said he would \u201cconsider all the points raised\u201d by the Times \u201cin any future efforts\u201d by DOJ to subpoena these reporters, adding, \u201csubpoenas are a tool of last resort.\u201d\u00a0<\/p>\n
