The Supreme Court\u2019s Republican-appointed majority sided with the Trump administration over Haitians and Syrians on Thursday in a ruling on the administration\u2019s attempt to end humanitarian safeguards under the Temporary Protected Status program.<\/p>\n

Justice Samuel Alito\u2019s curbed the power of courts to review government decisions to terminate protections under the TPS program. For this case, the majority said that means Haitians and Syrians aren\u2019t entitled to orders keeping their protections in place while their litigation proceeds, even though lower courts found serious legal problems with the administration\u2019s attempt to end their protections. <\/p>\n

In a dissent for the court\u2019s three Democratic appointees, Justice Elena Kagan said that without such postponement, \u201chundreds of thousands of Haitians and Syrians living in this country will lose their legal status and work authorization\u201d and that most of them \u201cwill have no legal option except to leave the country, even at the price of leaving family behind.\u201d<\/p>\n

Despite anti-Haitian statements by President Donald Trump and former Homeland Security Secretary Kristi Noem, Alito said there was a \u201crace-neutral explanation\u201d for terminating their protections, \u201cnamely, that the current administration, which has terminated every TPS designation that has come up for renewal, simply opposes the TPS program, at least as it has been implemented in the past.\u201d<\/p>\n

Joined by Justices Sonia Sotomayor and Ketanji Brown Jackson, Kagan said that both Haiti and Syria \u201care countries that
the State Department continues to list as too dangerous for
travel; they may be yet more perilous for a former inhabitant.\u201d She said Thursday\u2019s ruling means that \u201c[h]undreds of thousands of lives will be uprooted, most permanently, while this litigation to annul the Secretary\u2019s (likely illegal) termination orders proceeds.\u201d<\/p>\n

Lower courts had found the administration illegally sought to end protections for immigrants from Haiti, Syria and other countries. That led the administration to ask the justices for a ruling to give the government the power to immediately end those protections without judges intervening. <\/p>\n

Solicitor General John Sauer sought emergency relief in the Haiti and Syria cases, complaining that lower courts had been wrongly second-guessing decisions to terminate protections. The justices declined to halt lower court orders in favor of Haitians and Syrians but agreed to hold a hearing to decide the issue in the case, which also carries implications for immigrants from other countries. According to the Congressional Research Service, there were nearly 1.3 million people with TPS status as of March 2025 from 17 countries, including 330,735 Haitians and 3,860 Syrians.<\/p>\n

The termination decisions in question were made by Noem when she was head of the Department of Homeland Security.<\/p>\n

Lawyers for Syrian and Haitian TPS holders argued there was no good reason for the justices to intervene on the government\u2019s behalf.<\/p>\n

Opposing what they put in scare quotes as the government\u2019s bid for \u201cemergency\u201d relief, lawyers for Syrian nationals\u00a0\u00a0sought that relief \u201cfrom an order that preserves the immigration status of 6,132 people who have lived here lawfully for years \u2014 in many cases more than a decade.\u201d They called those TPS recipients \u201chighly sought-after doctors and medical professionals, reporters, students, teachers, business owners, caretakers, and others who have been repeatedly vetted and by definition have virtually no criminal history. The government apparently needs urgent authority to send them to a country in the middle of an active war.\u201d<\/p>\n

Similarly, lawyers for Haitian nationals said deporting their clients would place them\u00a0\u201cin mortal danger.\u201d<\/p>\n

In the Syria litigation, a federal judge in New York ordered the postponement of the government\u2019s termination of protections. The federal appeals court that covers New York the postponement while the litigation continued.<\/p>\n

In the Haiti litigation, U.S. District Judge Ana Reyes also\u00a0ruled against the administration. The Biden-appointed judge wrote that Noem \u201chas a First Amendment right to call immigrants killers, leeches, entitlement junkies, and any other inapt name she wants\u201d but that, as DHS secretary, she was \u201cconstrained by both our Constitution and the APA [Administrative Procedure Act] to apply faithfully the facts to the law in implementing the TPS program. The record to-date shows she has yet to do that.\u201d<\/p>\n

Reyes noted that the president \u201chas made \u2014 freely, at times even boastfully \u2014 several derogatory statements about Haitians and other nonwhite foreigners.\u201d Among other things, she recounted that he called Haiti a \u201cs\u2014hole country,\u201d suggested Haitians \u201cprobably have AIDS\u201d and complained that their immigration to the United States is \u201clike a death wish for our country.\u201d<\/p>\n

A divided federal appeals court panel in Washington\u00a0\u00a0to lift the district court order. The two Democratic appointees in the majority said the government couldn\u2019t show why it needed instant relief, whereas Haitians face \u201csubstantial and well-documented harms\u201d if they lose protections, including \u201crisk of detention and deportation, separation from family members, and loss of work authorization.\u201d Trump appointee Justin Walker dissented, arguing that the government is irreparably harmed by courts intruding into executive policy. He also emphasized the \u201ctemporary\u201d nature of TPS.<\/p>\n

In her dissent on Thursday, Kagan said the majority \u201cclaims to see no<\/em> evidence that race played any<\/em> role in the Haiti decision. But the evidence is there, plain to see, in the President\u2019s statements, which the majority (and for that matter, his own lawyers) cannot even bear to repeat.\u201d<\/p>\n
